Tell that to the insurance company. If you EVER hit anyone in the rear, it is always your fault 100% of the time, no matter what. You should have your vehicle under control at all times, if it is a blind bend, you slow down. Who is to say that biker didn't crash around the bend and was laying on the road unconscious?
Sure, stunting on a blind bend is retarded, but when all is said and done, biker wins this case.

Also leaving the scene of an accident // Hit and Run is a crime as well. Regardless of fault.

At first I was like man this stunter is stupid for doing it there, but when I saw the person take off I was like I hope they charge that person for everything. the suv does rear end the biker so it should be his fault. But I am sure that when the courts see that guy run they arent going to care about what the stunter did and drop the hammer on the driver of the suv
