sounds like maybe the return spring on your rearset is messed up or the pressure switch is just outta wack
if they are stock rearsets you should be able to press down the lever with your hand, and it should return to the stock position, if it stays down you need to investigate why its not returning, just grab some allen wrenches and take the rearset off and see whats up

Yeah, why do you have to push up for the foot brake (and how for that matter???) for it to return to normal position? You should only be able to push down on the foot brake, it should spring back up by itself.

I'm putting in my Clear Alternatives integrated tailight this weekend, hope I don't have the same problem, although my foot brake works fine. Was it hard to do? How long did it take?

if you always use the front brake, you can just disconnect the rear brake light switch (the only wire going into the rearsets)
that would solve your problem, but if you ever brake without the front its a bad idea

not sure why it would do it, if the lever is returning to the right position then the switch must be malfunctioning.
If that sounds right you can check ebay for a stock rearset w/ brake pedal and everything, and just replace the whole setup to be sure. Stock rearsets don't usually go for much

Mine did the same thing after i had everything powdercoated...the springs worked fine---i had to adjust the switch on the back of the rearset.
Hope this helps.

Just adjust it so it comes on and turns off when you need it to.

Just installed my Clear Alternatives tailight today and didn't have any problems at all. It's gotta be your rear brake pedal. Your bike is still brand new right? So why don't you take it back to the dealer to have it checked out?
