Sad story (wal-mart vs disabled woman)
I'm sure it was said here but i didnt read every post. The problem is the lawyer didnt go after more money from the trucking company. All the medical expenses + everything extra for causing brain damage. You can't bash walmart just because they have so much money. That is their money regardless of the circumstances. It seems the lawyer is to blame. If there was 470k worth of medical, that should have been the very base of the lawsuit against the trucking company. Should have gotten a million more on top of that for ruining her life.

I would like to know what what happens if the family doesn't settle? And as far as their son dying in the war, it is unfortunate but please don't begin to say that wal-mart should donate money to the family for his death, just so they can sue for that. Why even bring the war into this lawsuit? IMO CNN should never have even mentioned that because they are trying to place self pity upon the family because of how much is going on in their lives. It is very unfortunate what some family's have been through, but that doesn't give them the right to not have to follow what is in the insurance agreement she signed. People keep bashing wal-mart for suing her, but the courts have upheld wal-marts lawsuit so why should we not blame ourselves for who we vote for and place in offices of power?

But why is Walmart suing them for all the money that the trucking company gave them? They said that the should only get 1K. There was important info left out of that story.
I agree that we barely ever hear the full story. We are all entitled to our own opinions. There are definitely good points everybody has made. The family was dealt a bad hand. I think that the one thing we can all agree on is that the situation sucks.
The report said that walmart is suing for the amount they have paid so far which is slightly more than what the family settled for with the trucking company. Why the family lawyers say that walmart should only get 100K is something that didnt get said.
Edit- Look at it like this. If you get hurt and get disability for say 30% because of your injury. You can not work just like you were doing making what you did and still collect disability. It is sort of the same thing going on. The family would have been better knowing what was in there insurance policy before they settled with the trucking company.

The full story is always hard to come by. And news channels sensationalize everything for ratings and advertising dollars. But this story still strikes me as very cold on walmart's part. Although it may be in the contract, i think the husband said it best "Let them win on paper but let us keep the money"
I watched it again. I misheard the amount. Walmart wants 470K. The trucking gave them 417K. The lawyer said Walmart should only get 1K (dont know why). The Lawyer knew about the fine print in the policy. So why did he settle with the trucking co if he knew walmart would come for more than what they were getting? A very sad story. But Its really confusing.
That is awfully nice of them to drop the suit, its probably more of a publicity thing than anything. However, I don't think Walmart was in the wrong at all. A few of you guys have said it, they paid roughly $500K in medical expenses because the lady worked there and it was the policy. Once they were paid a settlement--which should of been a hell of a lot more than $417K if she got messed up that bad--it is completely within wally's rights to get their money back, and I think they should. It's not free money, walmart dished out half a mil to an employee that just banked up, why would they not go after their money? Remember, they were not going after the trucking cash like the news outlets make it seem, they wanted their original cash back, that specific money had just already been spent. Imagine your friend needed money because they were in the same situation, then they win a big settlement over it, well, wouldn't you want your money back? If the settlement wasn't enough, then they need to make it enough or go after more money, that is what the settlement is for after all. Who cares if they have 90 billion in profits, they didn't make that much money by handing out half a mil to everyone who needed it. Our government has trillions of dollars invested in a war we can't win, but where is their helping out with American's in need? Why is it Walmart's duty to do it?

This is an incredibly sad story, and I have to admit that it did get me a little misty in the eyes. The **** has just been poured on this poor family, but at least Wal-Mart has decided to do the right thing.
