Dude...there is no standard here. There should probably never be a standard, and I'm speaking in regards to practically everything. It should not be "treat everybody equal". It should be "treat people how the way they should be treated". There's a BIG difference. Rarely should you treat everybody the SAME. This family should have been an exemption.
For example, you have candy to pass out to kids. Each piece of candy contains 1g of sugar. There are 10 kids. You say you will give out 1 piece of candy to each kid. You do so, until you come to the 10th and final kid. Here's this diabetic kid (type 1) coming to you and he's in need of 10g of sugar. You say no. Rules are rules, kid. Here's your candy. The kid dies. You look at your bowl of candy and you had plenty left. Silly example, I know. Nonetheless, it gets my point across.

You have a job and you're the best employee, BUT you dont have a college degree. Company hires a guy that has a college degree but sucks *** at work and he gets payed more than you cause he has a degree.
So this is what you want? For him to be an exemption. He may suck *** but he has a degree so he should get payed more.
I can't believe they don't have some "Employee Assistance Program" type thing for this type of situation. - Hell - our little 3000 employee health system has a very nice program for these types of very odd situations that is well funded.

I could not have tried to say this any better! I am not trying to be insincere however this is what they are doing. Walmart probably would have kept paying her medical since she did have coverage. Why should Walmart not uphold their policy? I highly doubt they suggested the family settle with the trucking company just so Walmart could say hmmm lets sue the family now so we dont lose money. It is unfortunate how some things work out for people, that doesnt give any more of a reason to go against a company policy. Policy's are there for a reason, and that is to uphold the standard.

she couldhave been driving dangeriously, but things like this with trucking companies...do happen quite often do to their time.
This is a truely sad case she survived a truely caotic incident and ended up beinging sue over it...
i just thought of one that happened while i was still in HS.
this one girl was like top of the class and she was prom queen...
what makes me mad about is that she cheated the entire 4 years at high school...and we all knew she was. Ive personally heard them (her little group) talk about the pages of a stolen book for the class (notebook the was one of the teachers extra's) well anyways...she passed very high got like 10 scholarships and i had a struggle do to many things happening to me with in two years and im still not in college do to many little things that stop me from doing it as of right now. Well moral of the story is thati saw her about 4 or 5 months after HS - she had a 40k car she was wearing clothes that were from the look big bucks. and yet she cheated in HS and she got a better job...anyone else see whats wrong with this?

If they sued for meds, they are effectively double dipping, and walmart is in the right, and they were fools in doing so.
If they sued for pain and suffering (remember now mom will never be able to function as a normal person again, and dad and the kids will have to take care of her) then that is a totally different pot of money, and Wally world shouldn't be able to touch it.

How about a little twist to this story. Why doesn't Wal Mart donate $500,000 to theshank family for the fallen soldier that went to fight for our country and died? Then they can recoup the insurance loss of $477,000 they want and they will be the beloved Waaly mart again....

If they're hurting badly financially, they need to go after the trucking company for more money. The only way they wouldn't get more for pain and suffering is if the accident was her own fault. Which it must be her fault or they would have gotten more than enough settlement money from the truck co. for all their needs.
I would like to know what what happens if the family doesn't settle? And as far as their son dying in the war, it is unfortunate but please don't begin to say that wal-mart should donate money to the family for his death, just so they can sue for that. Why even bring the war into this lawsuit? IMO CNN should never have even mentioned that because they are trying to place self pity upon the family because of how much is going on in their lives. It is very unfortunate what some family's have been through, but that doesn't give them the right to not have to follow what is in the insurance agreement she signed. People keep bashing wal-mart for suing her, but the courts have upheld wal-marts lawsuit so why should we not blame ourselves for who we vote for and place in offices of power?
