Because they dont always use their lights when responding to calls.

I didn't know it was illegal either [&:]If their lights aren't on why not?

i also have heard that they are supposed to have their emergency lights on anytime they violate a traffic law though. at any point they dont have the emerg light on while committing a traffic offense, they are subject to the law as well. i saw that on court tv once on some show, dont remember, but it was pretty recent. they were talking about stop lights in specific, so im not sure if it applies to speeding as well without lights.
very rarely do you see a cop here with their lights on responding to calls. only when they pull people over. if you see a cop with his lights on and responding to a call, you know something is up, and there is typically a few others right behind the first.

RE: Pacing Cops
in Texas MARKED patrol cars do not have to follow the vehicle code, the reason they dont put their lights on 9 times out of 10 is when everyone see's red and blues the first thing they do is slam on the brakes. i was a Jailer for 3 years and rode with cops on patrol often, believe it or not you can actually get to a call faster by NOT using your lights or sirens. The only time they really use them now is when in a high speed pursuit, entering intersections or when lots of traffic is around ( i.e. freeway, expressway, etc) i didnt believe it either till i rode with the guys and one night we had to go to the same location 2x, the first time we used red and blues (fight in progress, weapons involved) and it took us 8 min at 120+ to get there (constantly had to slam on the brakes due to people we ran up on slamming on the brakes). (its a rural county, large area low pop density.) 2nd time just plain fight from the SAME location (running RADAR) it took us 4 min with no lights to get there. (people moved over when they saw us coming or we just went around them, no one slamming on brakes)

So, let me try to understand here...you paced a cop all the way up to 120?? What made you think he wouldn't pull you over? Pacing to 75-80 sure, but 120?

I'm sure there's some embellishment for a better story .. if not, you really don't notice a difference between avg. 60 to 80 cruising and when you're doing 120 mph !??!?
