Default problem with rear breaks

I've been fixing up the bike since I bought it, little things like turn signals, mirrors, rear seat lock, oil change and other misc stuff. Well the problem that I have is the rear rotor is touching the caliper braket when the axle nut is tighned to 70lbs, As soon as I loosen the axle nut it goes back to normal where it's supposed to be, but the axle nut is way loose. THe question that I have is my rear hub bearings are shot? or is there spacers/washers that were supposed to be there? What's up? I know the previous owner took the rear wheel off to have it powder coated so I am not sure is he messed it up or forgot to put the washers back in there. I want to get it done tomorrow, get my safety and start riding the bike already. BTW it's a 95 900rr.
