My lawyer sent him a letter requesting that he repay me the damages or I would file a lawsuit but unfortunatley the letter got returned. My lawyer also said I could try and sue his mother since she was the one that I talked to however, I'm not sure how strong of a case I would have against her and I don't have the money needed to higher the lawyer right now so it's kinda just stalled which is unfortunate cuz I was really looking to get this worked out quickly but I guess thats not happening now .

well sorry to hear that.. it does stink.. no doubt about it..
seeing you have no money and your just a student.. you should see what your state offers in terms of free legal services.. I know up here in my very liberal state you can find students of the law willing to represent you probono for the experience and such.. absolutely free.. I personally wouldn't just give up is all i'm saying.. and I feel for you pal.. I guess some people are just rotten, it makes you really appreciate the good people that are around you, that much more..
good luck my friend...

Whatever you put into the bike over and above the purchase price is your problem.
You are also entitled to remove the parts before you hand over the bike as they are not part of the original sale.If for example, you replaced the engine, you would be entitled to remove the engine before you hand it in. It is not a requirement that the bike should run or be roadworthy
If the seller doesn't have the funds to repay you, you may be in for a long wait to recover your original costs.

Clearly the guy that sold it to you knew it was stolen if he's not contactable now and said he bought it in a parking lot. I would sue his mother for sure, as that's the only connection you have to him. It might just push him to pay you back. I know if someone sued my mom for something I did I'd be paying them back real quick. Sorry to hear for your loss. It's messed up what people do to each other these days :[
