over the past few weeks I have been riding and checking my speed. In the lower range 0-40mph the speedometer is off by 5mph, in the upper range 45-70+ the speedometer is off even more....

I might assume that the gauge is actually making it worse since the bike has been laid down before by the previous owner. Would this make sense?

I have almost stopped looking at the speedometer because it's so far off going down the highway

It's because the amount off is based on a percentage, not a mph. So if its 10% off than at 10mph it will be 1mph off but at 100mph it will be 10mph off. and its not just your speedo that's off you odometer will be off too.

Mine was 1/10th of a mile over, so for every 100 miles i go it thinks i went 110 miles.

ok that makes sense. I figured the odometer was off as well, which makes me a bit happy because that means the bike has less than 20k miles on it. Is there anyway to figure out the percentage that the bike is off by?

If you have a GPS you can do it that way or use the mile marks against your odo to see how much its off

((GPS speed / speedometer)*100)-100 = % off

or

((GPS distance / Odometer distance)*100)-100 = % off

They recommend at least 50 miles for the distance one though.
