5-6 car length skid mark on pavemen will definitely show something to the judge. You may have a legit case.

I thought about this some more, and I don't see where him not actually hitting you is a reason to not pay! It was his actions that caused you to drop the bike, therefor his insurance should pay the damages. People don't go around jumping off of their motorcycle for the sport of it!

That's ridiculous. You got screwed because you took the safer route and jumped off the bike, instead of opting to potentially watch a car plow into you.

I officially recieved the paper last week. I have even talked to the Florida lawyers and so far 3/3 they have told me that since I have no "personal injury" then they cant take the case because Florida has crazy laws. Because I had no "collision" coverage I have to take it to small claims court. Just great.

Thanks for the input and be safe.

glad you are ok the bike can always be fixed. As a rider I always pay more attention to the cages around me as they all want to go faster than us for some reason. I try to know whats around me or coming at me, as you never know. It all happens so fast that you cant really prepare for it, and the laws are crap. Always give yourself room to go a diff direction or to get the hell outta some old folks way.

It is crazy to think that you would be legally better off if the asshat hit you!
