Insurance is a funny and annoying thing. - My co-worker was sooo pissed when he backed into a car accidentally with his pickup at work. - Broke a taillight on an early 90'sMercury Cougar - Probably a $30 part at a Junkyard - He was sooo bent when the owner ordered up a new taillight to the tune of $300. - The whole car is probably worth $1500.
From your perspective, you had a perfect bike that was 13 years old and irreplacable. - From insurance's standpoint, you had a $2700 bike that sustained $2800+ in damages.
It all depends on what side of the accident you were on - Sucks to be someone who bumps into a $100 car and has to pay thousands to fix it, and sucks to own a $100 car that has damages you weren't looking for through no fault of your own.
I have a hard time seeing any justification in lawyering up- seems like a waste of time and resources. - Insurance has no reason to jerk you around on it, and it seems like the only way to get them honest, but racking up fees does nothing to help out our high premiums either...
Again, do what you think is best - I'm not in your shoes, and wouldn't want to be either. - Stress I'm not looking for, and Time to spend on it I'm lacking at the moment. - Hopefully it will all work out to your satisfaction without having to escalate it any further.

There's no need to get personal with it. Even though it's obviously a personal matter to you, a letter like that won't change the fact that it's just business to them.

Clue....the insurance company.
All I have heard from them for 3, nearly 4 weeks is bullsh*t.
That bullsh*t is going to cease. I promise you.
I have given them more than enough information and my time.
I have even given them more time, than they said to me it would take to get things right.
Case made.

Point is, it is beyond reasonable time for them to pay up AT LEAST what I sent them in an estimate.
Plus, I am not sure that's the way it works anyway. States vary, coverage, companies, laws, and victims vary.
Just an aside story "Jeff" told me, a guy I work with now who incidentally used to work for a Honda dealership,
had his F3 damaged, by a car driver.
The adjustor was an ok guy he said.
The lady after the adjustor reported back was a complete bi*ch he said.
She had to ask him what the Blue book value of the bike. He looked it up and "addded about $1700 to it".
The lady yelled "fine but that's all we are going to give you!!!".
He got over 5 grand.
Just smiled and took it.

The point of this post is:
The insurance company is trying to be negligent.
They are past their own admitted time, and way past my patience.
A letter from me goes to them tomorrow, reminding them of:
1. What has been officially filed...and the photgraphic proof I have sent them already. The facts of the event etc.
2. What I have as photographic and written proof, still in my bag, that they haven't seen.
(I didn't fax all 40 photos to them, only about 6.)

just because your serious with your threats does not mean the people that read the letter will give a crap. Same with bringing up your Grandfather, doesn't matter if its true or not it sounds like a childish maneuver talking about how your grandpa will pull some strings for you. Ditto with talking about having a rich boss and such a great lawyer, while true, its not going to scare anyone.
To be honest, your letter as a whole sounds off. You mix "legal terms" with much works like "bike" rather than motorcycle, which is going to make it seem like your just throwing "big" words in more conversational/casual wording. I would suggest starting from scratch and sit down for a WHILE and come up with a more concise and less threatening. Threats would be great if you knew you were talking with someone who was in any postion to be scared of you. Most likely the person reading the letter has no real personal stake in whether or not you get your money. On the same note, your taking their slow progress as a personal attack which it isn't; incopetence maybe. You have a right to be a little impatient by now but it hasn't been long enough to be that angry/vindictive.

from their point of view, being overly descriptive with your connections and legal representation is just bluffing most of the time. Insurance companies deal with so many people that say they have the best law team in the world on speed dial and know every politician/judge/law enforcement personnnel in the state by first name, etc... that they rarely take threats like that seriously

All threats are gonna do it get your paper work place on the bottom of the stack. ANd if they give you $3000 for your F2, take it n run like hell. I know its worth more to you, n others like us, but to them its a old pos. Also it hasnt really been that long since this happend, and its the holidays. January, early Febuary is prolly more their time line. The adjuster dont control when the check gets cut.
