Letter I am sending to collect
Not to sure about that one. First of all I would be listing the faults/slackingof the insurance company, The kid has nothing more to do with it (he paid his insurance and ran over your bike, he's done).Anyway I thought theinsurance company had 10 days to get things worked out and adjusted by law (doesn't mean it will be fixed but that the claim is being processed?)
Also (not flaming or baiting)It may be true of the connections you have and your bosses lawyers. doesn't everyone use that? Im sure they hear it all day long and laugh it off. Have his lawyer send them a letter instead of telling them you have access to one.
I would just send the facts (pics, police reports, whats expected) and if no response turn it into your insuranceand let them go after the other insurance company. I had to do that when this guy rear ended me and wasn't listed as a driver on the policy and state farm refused to pay the claim so, I had to pay the deductible and got it back after they resolved the claim with state cheaters I mean farm, with no claim agianst my record.
Just my opinion

The total loss is probable - KBB Retail is $2730...
Insurance is a funny and annoying thing. - My co-worker was sooo pissed when he backed into a car accidentally with his pickup at work. - Broke a taillight on an early 90'sMercury Cougar - Probably a $30 part at a Junkyard - He was sooo bent when the owner ordered up a new taillight to the tune of $300. - The whole car is probably worth $1500.
From your perspective, you had a perfect bike that was 13 years old and irreplacable. - From insurance's standpoint, you had a $2700 bike that sustained $2800+ in damages.
It all depends on what side of the accident you were on - Sucks to be someone who bumps into a $100 car and has to pay thousands to fix it, and sucks to own a $100 car that has damages you weren't looking for through no fault of your own.
I have a hard time seeing any justification in lawyering up- seems like a waste of time and resources. - Insurance has no reason to jerk you around on it, and it seems like the only way to get them honest, but racking up fees does nothing to help out our high premiums either...
Again, do what you think is best - I'm not in your shoes, and wouldn't want to be either. - Stress I'm not looking for, and Time to spend on it I'm lacking at the moment. - Hopefully it will all work out to your satisfaction without having to escalate it any further.
(Oh, and sarcasm iscorrect over cynicism, but not if you spell it "sarsacm"
)

they will probably blow you off and wait for insurance to handle it with you. the way you add in about your boss and grandfathers influence will probably get you laughed at. 1 month waiting for insurance isnt that long @ all. i understand your position but the intimidation factor in there is just pitiful. the rest of your letter makes sense and is very thoroughly laid out and would make for a clear cut case. but it could be seen as though you as trying to pressure them into paying or they will have problems with such "friends of grandfather/boss" you are not in the wrong, so dont makeyourself look like an *******.

Then they can write me a check for the same amount that restores the bike, and I still keep it.
A totaled bike dos not mean I can not keep it.

My threats however are not empty.
I have not even become aggressive yet.
It has been more than 10 days, and the last SF rep I spoke to said an adjustor would be out no later than 12-18-2007.
That was two days ago.
All the extra info I included is to let them know I am fully aware of who they are, their clients are, and the witnesses
and visual and handwritten proof I have in my possession should they be stupid enough to want to go to the mat on this.
I am fully prepared for battle.
I thrive on confrontation. It's what I do mainly for a living.
Trust me, when this issue is resolved in my favor, I'll post pics.

Use paragraphs for all related items. Don't put 3+ separate lines about the same subject. If you need to list things, use the appropriate list functions (you know, with the little dots next to each item).

I love how it highlights words, phrases, and suggests better alternates.

thats lame.. letters are weak.., just have the attorney you are going to use.. call them or send them a letter from the law office with official letterhead..
this letter means dirt to them.. you dont scare them.. the lawyers do..
