Default Fuel Petcock

well this week i had to remove my gas tank, while draining it i noticed that when in the OFF position, fuel still flows pretty freely, not as much as when it is on, but i am assuming when the petcock is OFF that the fuel should stop. my question is when replacing this, is this a function of the ****(#13, in diagram) or of the petcock assembly itself(#5)

#5 : $43
#13 : $20

point being i would like to NOT spend $45 on the assembly if all i need is the ****.
