Accident
I just got hit by a car on my cbr yesterday because some idiot was reversing back like 10mph and apparently didn't see me. I was honking my horn for at least 5 secs straight. The person claims that he heard me but then it was to last. I ended up going to the hospital and got a sprain ankle. Now i am thinking about filing a lawsuit because the car hit the side of my knee first then knocked my bike over and then my bike fell on my other leg. What ended up happening to my bike was that the brake lever broke, the both pegs are messed and my rear fairing is scraped up because since i had frame sliders there was minor damages

I notice reving loudly catches the attention of people faster, those horns are worthless. Least you'll ride anotherday. Definately sue the **** outta his insurance dont go after him personally but get what ever you can out of the insurance company. Serliously I'm glad your allright sprained ankle will heal over time.

Glad you're not badly hurt
You're gonna need a couple things before visiting court:
A copy of the accident report
A lawyer
You should already be filing a claim on his insurance for damage to your bike, immediate medical costs and any incidentals. Things like tow fees for your bike, damaged gear (if your helmet hit the ground, you should replace it), ect. The lawyer will be necessary forr getting the more intangible things. Pain and suffering, time lost from work, possible future income loss (my job is physically demanding and any injury can affect my job performance, now and future).
If you aren't into the greed thing, you can prolly get this all settled pretty fast. If you go the pain ect route, it'll be at least a year before the insurance company begins to think of settling.

i am totally on ur side with this about being pissed at the careless driver and i am glad you are fine, but why the hell do you think insurance on vehicles is so ****ing high??? because everyone wants to squeeze a few dollars more outta someone else. it can't have messed up ur bike that bad, to need to take him to court. be sensible, use your ****ing head!!! even if you aren't going after that guy personally it will raise his insurance and raise everyone else's too!!! i mean are you really going to come out ahead, you gotta pay a lawyer n **** plus other bs they make u pay, plus lawyer gets a cut of the money if u win. so basically u gain hardly anything at all if u gain anything.

Don't get angry that this guy wants compensation for someone else's blunder! Get mad at the idiot who didn't look where he was backing up!
@OP: I almost got run over in my parking garage by some lady on her cell the same way the other day.. she passed a spot and decided to back up right into me! I revved hard, honked and yelled and was literally 6 inches from getting a piece of 4runner bumper in my headlight. Heal up quick and good luck getting your bike fixed up!
This type of thing happened to a fdriend of mine back in 1987. He was riding home on his new VFR 750 and a person backed out of their driveway(didn't see him) and he braked,and went flying over the car when his bike hit it. After 18 months in hospital he is fine now except for the wheel chair. Yes from the waist down no feeling. So everyone ride as carefully as you can and yes take the person to court. L.Potter
