I have to agree with this.

Also I believe it is illegal. The only way I would do this if I were youis to, type a written contract with the terms and amount of you make per hour. Have you and you boss go sit down in front of a notary and sign it. Also in the terms put that if anything was to happen and you were not paid in full. You would take him to court with him understanding he is responsible for all of your lawyer fees.

why not take the overtime and save your money? you end up getting payed more. I am very close to my family and would not even trust them to hold up a deal like this.

I gotta hand it to you man, you have a damn good work ethic. Starting at 3am and looking for work between your morning and afternoon shifts. Props to you!

Honestly, I don't see anything wrong or illegal here. Unless, your boss screws you out of the extra hours you work and doesn't let them roll over into paid time off. Ton's of jobs have needed to find ways to cut overtime pay. I know that government employees have a similar system where extra hours that are not pre-approved for overtime can be used as paid time off later on.

Also, I know a lot of jobs base overtime pay on hours worked over an entire pay period. So, if a pay period is 2 weeks (80 hours) you must work over 80 hours in those two weeks to receive overtime. Working 50 hours one week and 30 the next does not count for 10 hours of OT.

Like someone else said, you seem to have a good relationship with your boss and really seem to enjoy the work. I would take whatever hours he can give you and if you can get another job to bring in some extra cash, go for it.

All this talk of "overtime pay" makes me misty eyed for the days before I took a salaried job.

He's basically creating you a Paid Time Off (PTO) bank for a job that doesn't offer one, but without the option to cash them. this isn't a non-standard business practice, although usually companies that use a PTO bank, award the PTO hours per pay period, regardless of your hours worked. In this case you're making the hours that are going into your bank - which seems like you're just paying yourself forward.

You do 10hrs a week for 5 weeks, and have 50 hours saved up - that's a full week's worth of pay he owes you, @ your hourly wage. Go on vacation and you should still pull a paycheck.

Quit the job, or get fired, and he owes you for whatever hours are in your bank - and if there's nothing contractually binding him to pay you that, not even Judge Joe Brown would rule in your favor.

Be careful who you value at their handshake when it comes to money.

Thanks DammitMike, I figure I may as well be working during the day too, otherwise I just find more ways to spend money.

Thanks for the input everyone, there's lots of stuff to consider. I think I'm gonna take the deal. It's that or get my hours cut way back because they'll have to hire somebody else. Either way, I'm not gonna get paid overtime at the farm. If I want overtime, I have to find a new job.

I have no issue trusting him, he's the most brutally honest guy I've ever met and I feel that after 4 years of working next to him I know him pretty well.

Yeah even if its just on a napkin, that piece of paper can help make sure you can get your money if some less that fortunate reason he decides to f ya over. Otherwise it seems like a decent deal knowing overtime is out of the question. plus all the farmers i know are honest hard working folks who arent out to screw people over, there too busy being screwed over themselves.

Personally if it were me, I would have no problem with the idea of working like that. Before I went to college, I used to spend money like it was water. Now that I'm in college, $5 is a big deal (if its not for books or something school related). I would love to be able to go into work one day if I have nothing better to do, but I don't have that opportunity. Sure, technically what your boss is doing is illegal, but if YOU have no problem with it then go for it.
