Opinions? Would you take this deal?
In essence he's basically saying he wants you to work as much overtime as you'd like, he's just not going to pay you overtime wages. Pretty lame actually. The whole "time shift" thing is just a fancy way of justifying not paying you overtime. Your still working x amount of hours.. and getting paid for the same x amount of hours. He just won't pay you overtime.

Also I believe it is illegal. The only way I would do this if I were youis to, type a written contract with the terms and amount of you make per hour. Have you and you boss go sit down in front of a notary and sign it. Also in the terms put that if anything was to happen and you were not paid in full. You would take him to court with him understanding he is responsible for all of your lawyer fees.

why not take the overtime and save your money? you end up getting payed more. I am very close to my family and would not even trust them to hold up a deal like this.
I gotta hand it to you man, you have a damn good work ethic. Starting at 3am and looking for work between your morning and afternoon shifts. Props to you!

Ton's of jobs have needed to find ways to cut overtime pay. I know that government employees have a similar system where extra hours that are not pre-approved for overtime can be used as paid time off later on.
Also, I know a lot of jobs base overtime pay on hours worked over an entire pay period. So, if a pay period is 2 weeks (80 hours) you must work over 80 hours in those two weeks to receive overtime. Working 50 hours one week and 30 the next does not count for 10 hours of OT.

All this talk of "overtime pay" makes me misty eyed for the days before I took a salaried job.

Quit the job, or get fired, and he owes you for whatever hours are in your bank - and if there's nothing contractually binding him to pay you that, not even Judge Joe Brown would rule in your favor.

Thanks for the input everyone, there's lots of stuff to consider. I think I'm gonna take the deal. It's that or get my hours cut way back because they'll have to hire somebody else. Either way, I'm not gonna get paid overtime at the farm. If I want overtime, I have to find a new job.

I still don't agree, but, it is way better than being un-employed or getting your hours cut back so lacking the option of a better job your prolly doing the right thing, till something better comes along.

Yeah even if its just on a napkin, that piece of paper can help make sure you can get your money if some less that fortunate reason he decides to f ya over. Otherwise it seems like a decent deal knowing overtime is out of the question. plus all the farmers i know are honest hard working folks who arent out to screw people over, there too busy being screwed over themselves.
Personally if it were me, I would have no problem with the idea of working like that. Before I went to college, I used to spend money like it was water. Now that I'm in college, $5 is a big deal (if its not for books or something school related). I would love to be able to go into work one day if I have nothing better to do, but I don't have that opportunity. Sure, technically what your boss is doing is illegal, but if YOU have no problem with it then go for it.
