DUI mowing yard?
After coming inside from working in the yard all day, This got me to thinking. What all stats can you get a DUI while your riding along mowing your yard? or if not even drunk can a cop drive by and see you with a beer in your hand and cite you for open alcohol container in a motor vehicle.

This is a good question and can be debated...If you are inside your property, cops needs a permit to enter... Though I they sees you with a beer, does not mean your over the limit? What are the odds...but I assume it does happen though. Have you heard about the corrupted city of BELL.. City manager gets paid $800k + a year with full pension. His assistant makes more money that OBAMA. All the tax payer money, suck dry by greed. The police Dept of Bell was pressure to give out as much citations monthly as possible!! One of my friend has a relative that live in BELL, she park her car on her own property driveway, wake up next morning car towed by city. Cited her for a broken tail lights + impound fees...she plans in sue city official for trespassing and had an appointment to repair tail light following week.

from my experiences anytime a cop wants to do anything, your always on the losing end of the deal. Thats messed up towing a car from someone's house. You can park an all out junker in your driveway and it should be ok. As long as you own it and not rent they shouldn't be able to tell you what you can and can't do with your stuff.
Drink all the beer you want while riding that mower! No law against it.. while your sitting on your property you can get as drunk as you want..
Dont drive that mower onto the street tho. YOU CAN get a DUI.. altho its highly doubtful you will.

If there isn't a fence around your property, a cop can legally enter your yard (unless you have signs posted stating private at the property line). If your city / state has an ordinance against open containers and you're drinking on your riding mower in your unfenced yard, you've given the cop enough probable cause to investigate regardless of fence or signs. If you are operating a wheeled motorized vehicle, you can get a DUI. Of course, the cop would have to be a real pr!ck (or you'd have been one to him in the past) for him to go through all that.
Philadelphia has an open container law. A cop has harassed me for drinking a beer while sitting on the step of my private entrance to my apartment. He also had to cease harassing me when I opened the driveway gate and moved into the driveway with a lounge chair and cooler (fenced & gated is private property and he could not enter without invitation or probable cause).

Thats why you never cause a scene and stay on good terms... if a LEO knows someone by their first, Middle, Last and mothers maiden name and know they cause a scene while intoxicated.. I think it would be more of a problem then a regular joe just relaxing...

Atleast we will have a fellow biker on our side, for when cars try to run us over.
they have never messed with me much, my yard isn't fenced in but they have driven by a few times and seen me sitting outside in the chair on porch or on my mower, they just waved. I waved back, and preceded to get my butt up and walk in the house. Really with all the drugs in this country today shouldn't they have more to do then to mess with someone sitting around enjoying a beer and just relaxing, not messing with anyone
I was bbqing the other day in the back yard and a cop drove down the ally and yelled from his car what I was cooking. Anyway walked over to him with beer in hand and had a 2 min conversation with him. Didn't say a word about the beer. But I live in a small town with only 3 cars on during the day and 2 at night. But I guess that's offtopic since I was on a motorized vehicle.

Of course these are on public highways/roads, but on your property is specific to your State/County/City Laws. Police are not suppose to enter your domicile/house/residence without just cause/proabable cause/reasonable suspicion that a crime(s) is being/ has been committed. But once you step outside of your domicile/house/residence in most states/jurisdictions you can be cited/ticketed/arrested. Having a fence or posting Private Property signs won't keep the Police out, if there is reasonable suspicion about a crime being committed, they can enter your "fenced yard" and investigate. Just because you have a fence up and signs posted doesn't mean you are free from the Jurisdiction of the Law.
Sorry kind of got away from original question. The open alcohol container is up for debate depending on your Local laws like what Kuroshio said. The police cannot SEARCH you in your house or garden or someone's house/garden who gave you permission to be there(is what most laws say or something to that effect) but anywhere else is fair game. That just deals with searches is maybe where Kuroshio was getting some info from, don't know.
