I have a slight problem with people getting sprung for DUI on mobility scooters (yes it has happened in NZ).
I guess the problem I have is that you don't need a licence to operate a mobility scooter, but if you get pulled up DUI on one you will lose your car licence?
How the **** does that work?

great point, I think it should be more of a public intoxication then a DUI

Probable cause allows a cop to do pretty much anything. So if you're slamming down beers in your backyard and crunking to death metal music, don't be surprised if a cop hops the fence and begins the "WTF?" questions
But the guys saying they're on private property so can drink as much as they want isn't quite correct if there's no fence. A fence is a public statement, to everyone, the property is private. Even a half height decorative fence with a gate. The DUI would be pushing things. But if the cop wanted to push it, he could make it stick. PI would prolly be easier.
BTW, open container laws are what I call Gateway Laws. They open the gate for leos to investigate for more serious infractions mostly.

That's probable cause or reasonable suspicion. He doesn't know if it is beer or water. But he can invesigate it and will probably just tell you to put it in a Solo Cup or another container, just don't make it obvious if you are worried about it. If you aren't being loud and disturbing people you will probably not be messed with.
