This is a funny thread, sue the complex for not using concrete!!!! I'll bet the apartment owner drives a cage, and that makes everything HIS FAULT!

It's always the cagers fault you know, just ask most of the people here.

I love the fact that even the MSF course tells you that this will happen.

They make little kickstand pads that help with that. Or just use a beer can. You need to make the foot print bigger for the kick stand when it's hot and you park on asphalt.

the point is this, this is known to happen, you are not the first one to have it happen, you should have known it was gonna happen, and you didnt, its not the apartments responsibility to provide you with extra care for a hobby you are not familiar with. it is not fair to bring a lawsuit against the apt complex for your mistake. i suppose if you fell off your bike and you were not wearing a lid and hit your head on the asphalt it would be there fault for not having cushier pavement?

btw, that parking lot doesnt look bad at all, a few repairs which means they do have it maintained.

Good idea to look at the lease. The lease specifically states they are not responsible for theft of personal propery. Nowhere does it state anything about damages. Hmm

We got metal plates mounted in the parking lot at work in designated motorcycle parking just for this reason. I also keep a little plastic puck for when I have to park on asphalt. I was leaving WalMart once and noticed some poor guys bike sinking like quicksand. I bet he has no idea why when he returned there was a crushed coke can under his kickstand.

I agree with TheX. This thread is funny.

There is something in this world called hindsight. Ironically, it should be used in the fore rather than after. That hindsight can only come with personal experience and acumulated knowledge. However, your (the person aledgedly bringing suit) lacking in this area. As I said in an early post, chalk it up to the "peril" of ownership. But, you can't accept that this is your in-experience as opposed to blaming someone else's ability or lack thereof, for their lack of responsibility or reasonable responsibility.

It is quite obvious that you are more worried about blaming or holding somone else responsible for the damage rather than showing your genuine concern for getting it fixed. Well, at the least, that is what you are showing on this thread.

My opinion doesn't really matter, but this is a question morals not fault. Either that, or I come from a different era and this is normal. Either way, still a shame.

My neighbor kid was playing in my yard with my son. He ran across the dew covered grass and fell and bent his ankle back. Bad enough for that kid to be hurt and require to have xrays. I know that I could be held responsbile for this, so I manned-up, took him to the medical center, and did it on my own. The point is, I know his parents would never blame me or hold me responsible, but as I said before, it is a "peril" of ownership.

Have your own insurance company take care of it. Either that or you don't have that coverage, have high deductable, don't have insurance, don't want your own insurance to go up, or must want the fact that you might win a settlement and it show up on your credit rating, and anyone that runs it can see it, and might not consider you for something because of that credential being on your record.
