I didn't think about it being in your lease that very well could be, but check anyway. Lets say you go to Walmart, you go in and you get a shopping cart full of stuff, come out to your car load it up. As, you start to wheel the cart back you decide that its too far to walk so you just push it up against a pole and walk off and go on your way. Well lets say that the cart that you left against the pole gets loose and starts to roll and strikes another car doing damage. Is it Walmarts fault that you were too lazy to push the cart back to the cart return? No, but once again they are responsible, because they are the ones responsible for maintaining their parking lot keeping it safe for their customers.

Rbrandon try gettin walmart to pay for that one. Been there, done that and they have a clause too that says they are not responsible for damage to vehicles. Sorry buddy. And about someone breaking in to the car at the complex, If your gonna say that the complex is responsible for this guys bike because the heat melted the asphalt under his kickstand causing the bike to sink in and fall over then why not say the complex is responsible for the vandalism of a vehicle there? I mean they should have security measure set up to prevent this right? I mean if you believe that in some crazy way the complex is responsible for the asphalt heating up, melting, then sinking in causing this guys bike to fall over then you should believe that too right? I mean if he would have parked this bike in the grass and he came out an the ground had collapsed uder his kickstand causing it to fall and do the same damage, would the complex be responsible then? If you say no, why not I mean it is the apt complexs ground they should know that this would happen right? By the way not trying to be an *** Just want to bring some reason to this post
dude, asphalt melts everywhere, it happens to ALL of us, we just know better, and now you do. chalk it up to experience and get on with it. sorry about the mishap, but thats the way it is. i learned in my MSF about that before i ever rode.

dude what kinda maintanence can the apartment complex do to prevent the sun from melting the asphalt? If you read the post, the hole wasnt there already, the sun heats up the asphalt, causing it to melt, the psi from a 400 lb+ bike on abouta 2 sq inch kickstand pad is about 200psi. It happens. The thing is this kid should just be like damnit i f@cked up. lesson learned.Anyways heres your chance to shine. If you were this kids lawyer what would your openin argument be. Interested to hear how the evidence would lay out. LOL ps. what retail store you work for? Got some scratched on one of my vehicles I need to get takin care of. look at the lot! it looks like complete ****, it needs to be repaved. I never claimed to be a lawyer nor did I say that he should get money for it. I just said that it wouldnt be as far fetched to try and get money from the company as everyone else was saying it would be. As long as he was in a legal parking spot witch im not quite sure of, looking at where his bike was laying down, with the car infront of it. It looks almost like he just parked behind a car, cuz he had to run in really quick and whoever he parked behind got pissed. Just speculation I could (or more then likely ) am way off.
Oh I understand where ya comin from an yea its messed up. But Im just being reasonable. I come from a a law background, Hell I even took some prelaw classes before I found a new major. Dont see him gettin a damn thing. That and even if the parking lot was garbage, you noticed that from a picture. Just seeing a picture of the lot you said its ****ty. So the defense lawyer is goin to be like well did you not notice the lot was instable? You kno? Thats why Im sayin there are so many ways for the complew to get out of this one that its not worth the kid payin all that money for a lawyer and not benefittin from it. But hell if he wants to threatin the fact that he will get a lawyer, mayeb the apt manager is a idiot to the law and will agree to fixin the bike.
