Default why does rear brake assembly move?

my buddy just bought a 2001 cbr 600 f4i and is having trouble with the rear brakes, first off i live on a hill and 2 different times now he was going down my driveway and he said the rear brakes didnt work, also he says sometimes when he presses the pedal down he can hear/feel a clicking is that normal,? and lastley the entire rear brake assembly moves, so if backing the bike down my driveway and you use the rear brakes the entire assembly moves backwards until it pulls on the brake line stopping itself, and using the brake going forward it moves all the way forward and it pushes the brakeline into the exhaust and its starting to melt the brake line... what is supposed to hold the assembly in place?

The rear assembly should bolt right up to the swingarm. It definitely should not be moving. I'll post a detailed pic tonight.

Your question was bothering me because I couldn't remember, so I ran out to the garage and got a pic.

The bracket for the rear brake has a notch in it for the groove on the swing arm. It fits together like that and then the axel also goes through the bracket.

The brake bracket mounts through the rear axle and has sliders that locate in the swingarm so it can move with the rear wheel when you adjust the chain tension. When everything is installed correctly, the brake caliper and bracket shouldn't move.

thanks guys, i went out right after i posted it and saw the notch on the swing arm, so we took the tire off and fixed it real quick, i guess the previos person who worked on it didnt realize they go together haha. thaks for the help!
