Im out
unfortunatly you dont get the option of thaking the insurance co. offer, you pretty much have to take what they give. If you can bring them reciepts for any extra crap you had on the bike and they should reimburse you for that as well but I would expect something closer to what book value for the bike is. But the bright side of it is that your ok and getting a new bike!

o yes there is a police report and witnesses. And she tried to run. didnt get to far. the insurance will be cutting me a check for the fair cost of the bike tomorrow. I dont think I want to take less than 7500 dollars. Does anyone think I am asking too much or too little. Please justify so i can justify my offers to the insurance company.

You certainly can provide evidence to support a particular payout.
.... At a minimum, book values taking into account mileage and condition; ads with pics for similar bikes 2nd hand; receipts for accessories.
I fought the company that insured my wife's Corolla when it was a write-off and got them to agree to a payout several grand higher than the initial offer.
Any case, good luck with the 1000.

demonchild, i am no stranger to accidents i realize you want your money and are probaly very anxious to recieve however insurance company's hold accounts payable to anyone involved in the accident that is not the policy holder. for example 2 februarys ago i was driving a ford explorer in sleet and snow in alaska slid into oncoming traffic and struck a few vehicles . my insurance company "progressive" cut my 2 passengers a check for 3500 dollars apiece as they went to the hospital. This was not for the hospital bill this was because they incurred concussions during the accident and the insurance company is liable for their health by insuring a ****ty driver(me) to drive. They made no mention of lawyers or court to the insurance company so this was kind of a suprise for them. If i was you i would get checked out at the hospital if you have (slight concussion, blurred vision, trouble pronouncing certain words. after the accident i couldnt pronounce snowmobile for a month it kept coming out snowmobild. however i never once misprounounced or slurred the word "corona". Hope this helps .

ya but to get more money out of the ins. you would have to rack up a bunch of doctor bills...then if you claim you have a lot of permanat injuries and they pay you, you will be watch and will have to live like you are hurt bc if they catch you doing activities you are not supposed to be able to do...you will pay

Well the insurance is going to be more than fair. I am not claiming injuries although they are stated on the police report. I felt sore right after the accident but the pain wasnt severe. I reported it incase it became worse over the next couple days, however, the next day I didnt even know I fell. I still feel fine. I told them I did not get hurt, however, the bike did. My jacket is scratched on the leather and helmet, although, they do not need replacing. The insurance co told me to give them the reciept for the helmet. They paid 200 dollars for the jacket (max payout for each article of incidental) and I am not going to replace it. I feel the scratches can show off my battle wounds. They are going to include the cost of the gloves I was wearing although they are not that injured (sratches to the carbon fiber). Also, they are giving the full replacement cost (cost of the helmet to buy it new) of the Helmet so I sent them a receipt for my friends Shoei. The bike only had 6000 miles on it and looking new. They are paying me 7800 for it. I bought it for 6038 out the door.
The tires were new so the adjuster is going to pay for them seperately along with the cost I paid to have them installed. I had it done professionally at a cost of 391 dollars. They are also paying for the "average" cost of the jeans and shoes I was wearing.
All they ask in return is that I do not bring this matter up again and wave my right to further incure costs to their company in the future for future injuries that resulted from this accident. I gladly signed the paper as I probably wont be able to distiguish in the future between injuries caused from this or the numerous falls off of my dirtbike or other stupid stuff I pull constantly.
I think the insurance company was so nice to me because she is currently frying for felony hit and run. Anything I say has to go. She has already ruined her credibility. At the end of the day she is a stupid c u n t that has hers coming.
+Check cut to me: $9728
-Cost to replace gear: $500 (helmet, do not want to take any chances)
-Cost to pay off existing loan: $4319
-Amount I have payed towards
down, fees, liscence, payments: $1562
=Amount gained in accident
(i.e. what I have to spend
on a new bike
$3374
I WIN!

yeah you made out pretty good man... too bad you gotta pick up a new bike. Some good advice for you here my friend:
If you haven't made yourself more financially able don't get something that will require a longer(or more expensive)loan than you were already paying. In other words, I wouldn't recommend spending more than what you gained from the accident (3374) and what you were prepared to pay for your old bike (4319) or a total of 7693 or around there.[sm=nono.gif][sm=nono.gif]
