Technically the bike belongs to the bank untill he pays it off.
If he sells it to you (or anyone else) he is actually stealing it from the bank, and you are buying stolen property. (BAD NEWS)
If he wants to get rid of i/ can't afford it anymore, his best bet would be to talk to the bank, see if they'll accept giving the payments over to someone else, or defaulting on the loan, and giving the bike (repo) to the bank.
Selling it as a stunter without a title means he is selling stolen property. Just because a lot of bikes for stunting don't have a title doesn't make it any less illegal, and most of the time those bikes were somone's pride and joy before they got whisked away on the back of a truck. (One of the reasons I dislike the "stunta" culture)
If you REALLY want THAT bike, see if the bank will forego the interest/ penalties in exchange of you getting a loan to take over the payments. Otherwise find another bike.
And it would be wise to question the friendship of someone that will knowingly land you in jail by selling you "hot" property.

Cool, Sorry it didn't work out. Yep, deffinately steer clear of the guy.
Keep your eyes peeled though, there's always good deals to be had, specially now that the riding season is coming to a close...

All in all, I would be shying away from the whole deal
however, I wonder, it's not illegal, nor does it void your title to modify the engine of the bike, the plastics, etc
so could you feasibly (aside from the wrong of it) buy the parts and throw out the old frame? and get a title?

Soccer:
he would still be knowingly buying stolen property...
And he could get caught.. even though it is not normally checked (cause its a PITA) the engine, tranny, and swingarm have serial #s etched into them. hell even he wheels have them...
just because you're likely to get away with it does NOT make it any less illegal.
