Default Is my rearset bent ?

So i did a search and didnt find anything quite as specific as what i'm looking for. My rear brake lever is touching my swingarm (not the lever itself but the linkage - see pic ). Maybe it's a dumb question, but does this mean my rearset is bent ? I dont see any visual indication of it being bent and when I bought the bike a month or 2 ago i dont think the lever was like this. Problem is, it has not been dropped since then and the only work ive done was changing the tire.... any ideas on what couldve caused it or if it even looks bent ? Ill attach pics. Thanks guys !

I believe your rearset is bent. Here is a picture of mine:

Yours looks a bit bent in the picture too.

As far as what caused it, I have only ever known of dropping a bike to cause that. You sure it wasn't like that when you bought it from the P.O.

It probably was but i didnt notice. The only reason that i noticed the other day was because it started sticking. Def. Seems bent compared to yours looks like i'll be in the market for some new ones ! Ty sir for the pic and info.
