Starting your bike in gear

Ok... let's start this...
Kickstand - switch is fine, if it wasn't your bike would turn off as soon as you go into gear from neutral
Battery - Battery will be fine, if you can start the bike in Neutral, there is no difference in power usage to start the bike in gear... (Checking your battery is easy though and is good idea to check anyway... bike battery off should be 12.5v~, when starting bike during crank voltage should not drop below 10v~ and once bike is started it should be around 13.5v~... if during crank it drops below 10v, there's dead cells and time for a new battery.)
Let's see... when you try to start when in 1st and it doesnt crank, if you shift to N will it crank normally?

ya, everything is fine in neutral, i thought maybe this series of bike just only started in neutral. i dug up this thread from the F4's https://cbrforum.com/forum/f4i-main-forum-11/motorcycle-wont-start-while-gear-clutch-squeezed-90421/ do we have the same switch? they say its the two wires going to the clutch and i definitely have those, but there are no pics in the thread so im not sure if its the same.
and i might need a new battery yes, but i dont think that would be the problem considering i started the bike all season with this battery no problem.
