Is your kickstand down?
Your bike should start in neutral with the kickstand down, or in gear with the clutch pulled in. If there is any deviation from this I would check the switch for the kickstand because thats probably the culprit.

Your bike wont start in gear with the kickstand down. Hope it is as simple as that, which I bet it is.

I'm sorry, did he answer the question?

The bike is designed to not to start in first gear, if the Stand is down. Is the stand down? If it is down, then this is by design and nothing is wrong.

Matter of fact, to prove the point further, after starting, putting the bike into gear with the stand down, should, by design kill the motor.

Yeah, so why don't you make sure that the switch is working properly and not giving you a false-positive. Since the switch is DESIGNED to produce the kind of results you are having when the kickstand is DOWN, maybe if it is faulty it is causing your problem. sheesh.
