cbr info/help and advice

Default cbr info/help and advice

hey my names mike i recently got out of the service after serving for 3 years and i just got a bike and figures i got myself into this and i need some help / advice

so this is what happened i bought an 06 cbr1000 from a guy off criagslist.. he had a loan out on the bike and still owed 4100 on it i payed him 4500 for the bike ( watch is a good deal ) we went to a notary had a bill of sale made up saying ( he sold me the bike with the vin number for 4500 and is going to pay it off and i will get the title in 2 weeks also i want to add the loan place also hold the title so until the loans payed off i have no title for my bike and if he stops paynig on it they will come take the bike ) well that was more than a month ago and dude is playing the ******* card....not picking up his phone, no texts back, etc so i called the loan place and found out he never even called them or even better never payed off the loan and the loan place has been trying to get a hold of him for the past month i feel like going to this dudes house and smashing is stupid ****ing head in but i know that wont help me get my money back

my question is what can i do? can i take him to small claims court? and if yes i can what if he has nothing worth 4500 to pay me back? i have read that if he doesnt has any money or have anything worth paying me back that i am pretty much screwed so i need a much help as possible here



also since the loan is in his name can i just go buy a clean titled frame swap everything over to that new clean titled frame and wash my hands from this whole deal? like if the loan place comes to get there bike ( they know i now have it ) can i get in trouble for swapping frames? or can i hand the loan place the old frame and say here you go this is how i got it can i get introuble for doing so?

with re: to the frame swap .. thats ILLEGAL and im sure no one on here will support that or give you the advice on that
yes you can get in to trouble and arrested for swapping a frame like that

with re: to your situation
there is nothing you can do
loan is in HIS name... BANK owns th bike legally ... so at the end of the day if they want the bike .. they can come take it and there is nothing you can do about it

you need to get a police officer .. go to the house and try to intimdate him that way bring your paperwork with you that he gave you

lesson learned here
DONT GIVE SOMEONE $ til you have a title in hand

BTW the loan place (bank) owns EVERYTHING on that bike
and the engine has a VIN # on it too
so do not do anything illegal you will go to jail that way

Wow this is really a crazy situation. You've served our country and look at how this dude repays you. I totally understand you wanting to smash his head in but as you mentioned it isn't going to bring you anything but a jail cell.

Man, unfortunately this happens all the time and there a lot of victims out there. Scams are a multi-million dollar industry.

I'm sure this is a lesson learned bro. I agree with Toptaz1000rr. You should report this to your local police department an see what they can suggest.

Also, just a piece of advice, when and if you purchase another bike make sure you check the title carefully and match it along with the VIN # on the bike's frame and engine as there are PHONY titles out there that look real. If numbers match up your good.

I friend of mine bought a bike without the title as he was in the same situation but he literally walked into the bank with the seller and made the transaction. It worked out for him and he later received the title to his address.

I have tried to contact the police and they pretty much do not want a part of it I am going to take this d-bag to small claims court I am going tomorrow to fill out the paper work it's a pretty clear case of theft and fraud and this dick bag will pay for what he has done i hope the judge sees it the way it really is I just want my money back at this point and yes bug lesson learned here never again will I buy a bike with out title in hand this has so far been a nightmare thanks guys for your help here and info I will keep everyone posted on what goes down in the next few weeks hopefully he goes to jail that's what I really want to see happen I have heard that in pa if it's over 5000 it's a felony and that's great to hear cause he's paying 4500 + what work I got into the bike ( brand new tires , chain , etc
That's over 500 there do his total now is 5000 + court cost I have a great feeling he's not going to show up to court and I win by default

And thank you it was a blast and it was just my job have a great new year everyone!

Sad thing is the Court can only take what he doesn't owe money on to someone else, to pay you what he owes, so even if the Court wants to help you, maybe they can't and all that happens is he "does some time" Which doesn't help you get your money back.
People like that give the rest of us motorcyclists a bad name.
