I was told by DOT that whenever we change the type of headlight, it's illegal. Is it because you are not changing the actual headlight?

Kind of a gray area right now before it was really illegal because you are altering an oem part to non oem function.
But now with Audi and BMW and Merc all doing this as a stock option you probably be able to do it with out being noticed. As long as they are white and and the really light blue then should be able to slide by.

Your bike is all ready illegal.. The pipe and the undertail kit...
Pipe is too loud in terms of decibels, and the undertail the signals are too close to the brake light...

ha ha yea I knew that. With HID at night, when cops are heading towards me, I am hoping that I am not blinding them. I don't think cops really know how each motorcycle looks out of the dealer, so I don't think I will get ticket as long as it is not too obvious.
