I would say that guys tend to be stupid from birth up to and sometimes past 30. I think 28 is when a male adult actually finishes maturing and starts realizing the consequences of his actions. Which is why you read of so many male rider deaths. Men tend to push the extreme more...for the adrenaline rush. I wonder if the percentage of female riders in fatal accidents are lower than male.

Anyway, it doesn't seem that this guy is at fault...but the permit issue will probably be a big problem. If you are riding when you shouldn't be (say after dusk on a permit in some or all states), you are already violating the law. That is not a good situation to be in. In PA, you can take the MSF class and get your license after successfully completing the class. Plus you learn some useful techniques that might have mitigated the damage or even prevented the accident. Barring other factors, I think in PA, accidents are usually put in the favor of the person being rearended.

Just a note: If you want to show maturity...proofread your posts before making them. Frequent mispellings and major grammar issues automatically causes most people to think of you as being immature. It's a perception thing.

cyber....first...calm down....i am not ragging on you....really, i'm not. Woo, I agree guys are stupid for a long time...ha...but what i am trying to say is that it is almost directly proportional, the younger the age, the higher the risks for dumb mistakes....Cyber, you said it yourself, guys you know your age do stupid stuff on their bikes....

listen, i know it stinks to have to have a permit, but if they didn't kids like the ones you're talking about would be on the road quicker and more would be hurt....are you a safe smart driver....i don't know...you say you are and i am not going to try and dispute that, but you have to understand, licenses and permits are not given on a case by case basis....the law is there for everyone.....it sucks yes...but deal with it...

it's not about letting older "adults" crash...it's that maybe and i stress this is purely hypothetical, an adult would have called a cab instead of riding late when his skills aren't perfect yet, maybe he would have stayed off the road...maybe he would have thought "oh crap, i don't want to get caught on a permit"....different thought processes occurr as you get older...not saying you are a bad driver, but anyway you look at it, it was a bad decision to ride on your permit, you know you shouldn't have....what happens when you know you shouldn't drive 100mph...but you want to "try it".....these laws are to protect you as long as the law can from doing something stupid....in the process will some smart kids that wouldn't do that get crapped on a bit...yeah...but overall...it's a good policy...

lastly, and i will get off my box...don't say you are losing $1000s of dollars because of the law, or that because you are a kid...now you are babbling and trying to shift blame....had you not been out on your permit, late, past the time you should have been out, this wouldn't have happened...yes the girl caused it, but YOU played a part....it's not like someone screwed you over...you made a choice, you took the risk to ride out after dark...had you gotten pulled over....no accident, just pulled over and got your permit taken away....you would have bitched about, but in the back of your head you know you risked it...your choice...same thing here....you risked being out after your permit and risked all the bad things that could have possibly gone with it if things went wrong which they did....i know...it sucks....and i hope for the best for you....but don't shift blame...

you made a bad decision.....maybe on a good day nothing happens, but you had a bad day....bad day and bad decision usually equals crap....the best thing to do to make yourself grow up and be responsible...take ownership of your own screw-ups, don't blame others or the law, and think about how to resolve things, but don't shift blame....

i am calm lol

i know some of it is my fault why i may not get anything from her insurance or her. becuase i did decide to go out on my permit. i gues i did try to shift the blame of that to the law. but what can i do?

i am just going to wait and see what happens. i cant ride for 2.5 months anyway beucase of spleen then it winter. if i do end up having to pay for it i have like 5 months till its riding season again. i been trying to look at it in a good way. i get to work on my bike some more and will have a new paint job.

ill let you know how it turns out.

that is the exact way to handle this...it sucks, realize you messed up, she messed up and pray for the best....(at worst, look at the bright side...lol)....this is one of those situations that you grow from...i guarantee, you won't ever put yourself in a position like this again...the day you forget your license and realize it, you'll go BACK home to get it...just in case....live and learn....

i hope everything works out, i really do...she should pay you for being an idiot, but alas, sometimes the world doesn't work out as its supposed....post some pics and let's see what happened, might not be that bad...right??

would say it's her fault. you said she ran the red. which i think your trying tos ay is that. "she didn't completely stop" and what not. so i presume by doing that she should be at fault, and you said you got two witnesses. :P

i talked to her insurance i called they said they are waiting on the police report.

i am going to pick up the plastics from my brother this week. will get some pics and some of the bikes when i am over there.

i am hoping i can ues the plastic welding techniques that were disscued in the how to forum. if i can get them nice enough i can get a new paint job and it will look better. if not i can hopefully fix to ues as track plastics next year.

other wise i am going to have to get the painted ones from ebay.

the damges is mostly cosmetic besides the oil pan and head lights. the front brakes did lock up after then they started working.

nothing is bent but i dont see how. i hit her hard enough the back tire came off the ground.

and thanks for everyones thoughts on this.

I haven't read all the posts, so sorry if this was convered.

If witnesses say that she turned right on red out in front of you it is her fault even if you hit her in the back. Most police and other humans will tell you it's automatically your fault if you hit someone in the back but there are instances where it would be their fault. (stopping short is illegal for one) In this case she did not yield, and even if right on red was allowed, she has to stop and turn only when safe to do soby law. You having or not having a license has no bearing on fault on her part as she could not have known that before she turned in front of you. Have your insurance company go after her and you may need to hire an attorney and go after her and her insurance company in a seperate civil matter. Good luck and I wouldn't fix your bike just yet. Make sure you get an appropriate quote for repair and only do as much as needed to get it rideable. If you fix it up and it only cost $600 because of cheap or used parts, that's all you'll get from the insurance company.

Aye, I wouldn't even start doing ANY fixxer upper on the bike...a dent the size of a pin hole can be fixxed up easy but if you have it quoted by a shop it'll run you a grand if not more. (based off my car's quote)

OK after all that reading...OMG....chalk it up to a life lesson and quit being so sue happy.Im sure that still living with mom and dad has alot to do with it but i would worry about maybe working on youre grammar and spelling first before you emabarass yourself in smal claims court.Its my understanding that if you collide with someone in the rear half of their vehicle..ITS YOUR FAULT...following too close.

This is really the reason why we dont let kids drink at 18....sorry...i know i was 18 once and drank in the ARMY yadda yadda yadda.,..but you have to learn to be held accountable for your decisions....ACCOUNTABILITY...thats a life lesson...there may be a time when the choices you make affect more than yourself..
