Bike got destroyed on the freeway...questions on liability
It's a tough situation. You might or might not need a lawyer since you weren't hurt. Insurance companies can take forever to pay out, but if you get a lawyer to get yor $$ faster they can charge as much as 1/3 of your settlement. I was in a car accident in January and was injuured, though not severely. I hired an attorney to get a faster settlement and I STILL haven't gotten paid. I just last week finished paying off my medical bills out of my own pocket and am waiting for my reimbursement check.
So here's the update after speaking with the insurance company of the guy who owns the Murano
1)The insurance company will only pay out a total of $10,000 for both damage to the Lexus they hit and the value of my bike.
2)They said it could take up to 3 years to compensate me.

gotta love insurance companies. quick to take your money but slow to pay out. i don't know about that 10k for both vehicles. i think it should be per vehicle. also i think in CA the min. liability insurance required is 15k/30k. sounds like a stingy insurance company.

Exactly....threaten them and they'll wisen up....all they should need is the police report and your bike....its their job to fight over who pays they write the check and its not your problem....

@ 1st this sounds like a Fcked up thing to say but truth of the matter is sometimes you get screwed when you try to help people. wether its family , friends or complete strangers .. dont lend money to family, dont get your friends a job where you work and dont put your self in jeopardy trying to help a stranger (most of the time, but sometimes you just have to do the right thing) my buddy got hit on the freway doing the samething trying to help someone who was in a accident and before he could get off his bike a @#%& hit him doing 80 mph from behind when he was @ a complete stop.. luckily he is still alive and doing better... just becareful when you try to help people , some people arent worth helping

Anyway, most motorcycle lawyers won't help me out because I wasn't injured so I'm looking for advice on how to write a demand letter.
I am not sure what insurance company you are dealing with but, since you are in california, I feel confidant in the information I am giving you. As another member posted, CA minimum is 15/30/5. 15,000/30,000 is for Bodily Injury and the 5,000 is for property damage. Murano driver could have had 10,000 in coverage hence the aggregate limit the insurance company is obligated to pay. I know it sucks but that is why increased limits of liability are so important.
