first bad accident. need some legal advice

Default first bad accident. need some legal advice

sorry about typos hands still stiff just got home from hospital
this is about the accdinet not the part about me being screwed by the cops. thats down more

i was on my way home from work on my bike at 1:30 in the morning. i was following my manger so he could change the light for me down the highway a bit. so getting off a exit to the highway it splis in to 2 lanes then a good way down theres a light. i pass my manger as soon as the lane splits. i ride beside him for a second then pass him. i have a green light at the intersection. my manger is probley 75 yars back maybe more. i always slow down going throught intersections a little bit incase of cops if i am speeding. i was not speeding but still slowed. now i am in the left lane my manger i passed in the rightstill 75 yards back. theres a car coming to the light to my right. i could not be any more visible and when i cross under the green light she turns out a wide right on red. she did not stop fully. she comes directly in to my lane the left. she was probeley going 25 i was doing 50. i think but not sure that her bumber hit my front tire a bit . it may not have tho. there was a dent on her bumper driver side but i may have it her. i did not even know she pulled out till it was to late. so i go down right after the intersection. i hit my front brakes hard when i saw what was happening. my manger and a kid in his car saw my bake tire go in the air then my bike fall over. i went tumbling like 7 times. i saw the road then the sky over and over. i was thinking when is this going to stop. i had tenis shoes on and jeans. but a riding jacket gloves and helemet. the helmet is scraped up bad with busted vents. the gloves a small tear. the jacke has scuffs and a larger tear on the left sleave. i got light road rash on the arm there. my feet and ankles are fine suprisinly. my left knee thought has no skin left realy my hands and forearms got hit hard so they got swollen and stiff. road rash on my butt. i was in the hospital for 5 days becuase of a bruised spleen. i think i got very minor injurys for doing 50 and going down. the bike has a cracked clutch cover, messed up front fair, headlights, and right fairing. it must have flipped becuase theres damage on both sides. its mostly cosmetic. the dodctor said i cant do phyical things for 3 months becuase of spleen so there goes this riding season so i will fix over winter.

now heres the part that makes me angry.
the cops screwing me

there was a cop behind my manger when this was happening. he had to be a good ways back becuase his report is so wrong. from what i said before up there it sounds like it is the car who pulled out fault right? the police report says i passed, switched lanes, and hit her all in the intersection and i was doing 40 it says. now how is that possible? its a short intersection. they make it sound like i was in a blinded spot behind my manger and then i switched lanes and smacked in to her. now if this were true my manger would have hit me because me and my bike went over to the right lane when i went down. after i tumbled got up took gear off my manger was jsut coming to a stop at the end of the intersection. there is no way he was in the itnersecton for me to pass him when i was. i was charged with a dangrous pass also. so i have to go talk to the investagting cop tonight about it becuase its so wrong. i have 2 people who were closer then he was and saw it all. i only have liabilty and am 17 so if i get screwed my insurance is going to sky rocket and i will have to pay for my gear and bike.

i am being told by people i knoew that becuase the cop said he saw it they will go with him over the 2 people who saw it plus me. i cant afford a lawyer so do you think if i can prove most of it wrong becuase its 100% impossible for me to pass swtich lanes and wreck in a intersection doing 40 they may throw out his report? any advise would be cool

get a lawyer. you won't have to pay for one up front. go and at least consult with one. i couldn't afford one when i got hit, never had to pay a dime. they sued the person's insurance company and i walked away with almost 10,000 after all the medical bills and lawyer fees. i would definately get a lawyer knowing what i know now after being hit.

the thing is though i only have a permit. i was not aloud to be out that late. i figured i could fight it as much as i could with out one. and what happens happens

call 1-800-motorcycles the motorcycle lawyers. if you have been hurt in an accident regardless if its your fault and even if you dont have a licence or insurance we'll take your case... thats their commercial

seriously though consult a lawyer because they will try and screw you over without one.

You also have your manager as a witness. He knows the cop was behind him. His and his kids word combined with yours should prevaile over the cops. What about the lady who ran the light? What did she say happened?

Hello & Welcome!!

I know that sucks, but you have every right to speak to that officer and talk to him about the report. It is possible that the report can be changed....if not, get a lawyer go after the driver and the police officer....especially if you had witnesses....

If you rear end a car turning into your lane in a intersection then its her fault hands down. Unless you were speeding. But you were not. And her mistake is saying she did not see you. You didnt just apear out of no where. Talk to the cop and to a lawyer.

Tough break, mate.

Cops who lie about what they really know,to secure the outcomes they believe are right. Gotta love them. I think most everywhere in the world they are trained to be like that. If only they could be more accountable somehow. Anyhow, I agree with the others, get a lawyer and fight it, it's your best shot at a fair outcome.

As for the driver, people's ability to 'not see' us is truly staggering. I have about a 5 minute ride to work and usually get swerved into without warning 3 or 4 times on this journey. Maybe one in every hundred such incidents the driver checks over his shoulder, but even these ones usually lane swerve anyway. I'm lucky I'm usually perceptive enough to pick out the impatient ones and predict when they're going to swerve. And people wonder why we lane split to get out in front...

Cops are not always right. I have had a report changed before becuase of blatent disregard for the facts. You need to personally talk to the police chief, sergeant, or whoever is in command where the cop is stationed. If they cannot clear the incident up, consult a lawyer.

By the way, she is at fault. She did not properly clear the intersection before proceding into it. There is a law in every state that says something to that regard.
