I went to the local Honda dealership today. For $38 they will examine the motor (not tear it down) and give me a written estimate 'backed' by the dealership.

FYI:
- unless Honda has a surplus of a particular engine, you cannot purchase a new complete engine from them.
you're optionsare to either have your engine rebuilt by them or other mechanic, or buy the individual parts to rebuild yourself; there are no "engine rebuild kits" sold from Honda
- the cost for this particular dealership to rebuild a CBR 599cc motor is between $2500-$3000.

I will be renting a U Haul to trailer my bike over there for an inspection/estimate. If interested, I'll let y'all know.

 

WOW. sounds like it'd be cheaper to buy the used motor on ebay, rebuild it to be certain and scrap the current one. but the $2500+ rebuild would hold up nicely in court.

 

Yep Hurricane, Ebay would def be cheaper. At this point I am systematically following the legal advice given to me, hence, the trip to the Honda dealership[sm=smiley23.gif].

 

Mac, when you take it to small claims Court, take all the written estimates, plus copies of statements by people who were present when it all happened....from the police who attended the call would be good. They can testify that the bike was OK when you had to leave.
Take many pics of the damage to show the Judge/Arbitrator the extent of the damage.
It shows the Court that you are attempting to show as accurately and truthfully as possible what took place.
The question is - even if you get an award from the Court, will your brother be in a position to pay it ? If not, get a court order to seize property and sell it to recoup your losses.Losing his car might be a lesson well learnt....
Be prepared for the 'I didn't do it' defence from your brother - you may have to PROVE everything that you allege he did, so be prepared.
Make up a statement for the Judge that you can read to the Court, and make copies of everything for your brother and the Court.Give a copy to the Judge - he'll let you read it in open Court, but then has a copy to refer to later when pronouncing judgement.
Tell the story as it happened, dates, times places, everything that you know, can prove, or can remember.
You are claiming to have your motor rebuilt by Honda Technicians, or a new motor from Honda, depending what the Honda guys say - NOT the cost of a secondhand unit on e-Bay.

My brother works for Exxon. He also told the police officer (that escorted me to pick up my bike) this info as well when he was asked.Why would the cop ask my brother where he's employed... because my brother started to whine about how he couldn't go to Dallas and make his $2K forseveral days of work because of all this. I just thought to myself that this is so whacked how this jack*ss is the one that caused this in the first place, and he's trying to make it look like I have inconveniencedhim... . Too far gone with the amphetamine use I guess... I don't know how he stays employed??.
I'm going to try and get affidavits from all police that responded... they witnessed me pick my rim up from down the street, the metal bike stand laying in the front yard that my brother had tried to hit me with, the amphetamine Rx (bogus Rx?) bottle (no FDA label warning??), retrieve my glasses from the bushes in his front yard (removed to defend myself), and that when I went to pick my bike up the following day- it would not start; and mind you, how did I get to my brothers house in the first place?? -On a "excellent mechanical condition" (per the guy that sold me the bike; his advertisement) starting and running motorbike. I don't know if these patrol cops will even help me though, as I get the feelingthey would rather not be bothered. If I can justget them to provide me statements for what they witnessed, I believe my case will be won easily.
I got plenty of pictures too; before and after.
I also wrote a statement detailing everything that happened... unfortunately, it happens to be 10 pages long.
All I want is for my bike to run again, and not crap out on me as a result of my brother's sabotage of it. New/old... I don't give a damn! Without going into details here, I'm an OIF Vet (2003) and lets just say... in the short time I got to ride it (about two months/4000 miles),its been wonderful for me in many ways. It's the one recreational interest that I have left. It always put a SMILE on my face. The power is incredible and must be respected with self control(its so easy to twist that throttle)! I bought it for $2500, itHAD 28,000 miles on it...now it has somewhere around 32,+++ miles on it. And I was only riding every other week during that time. Damn I miss my bike!
