Default Flash to Pass question

I needed a new blinker switch for my 04 CBR1000RR.
I was told I could get either the normal one or one with the flash to pass option.
How does this work? Is this legal in the US? Is it a separate button or a special headlight flip of the switch?
Would it connect right in to a present US bike or is the wiring different?

It's just like a flash on a car. It's a button you can press to simply flash your highbeams...GSX-Rs have them built in and they are perfectly legal.

I could see where it could be extremely useful for those who use the halogen headlamps, but it would be worthless if you have an HID modification.
