FFingers we can expand on this forever. Your point is sound, give an inch they'll take a mile. Make a law to prevent fools from going that xtra mile but then the law becomes a tool for companies, lawyers, judges, the governmentto exploit, to interpret.

Ignorance is not knowing how and why others exploit and can exploit the laws.

Anyways as for Cyber, I do agree with everyone else that your kind of screwed. Best bet is to pray the judge is a motorcyclist and a happy camper when he wakes up that day to hear your case. Probably should get a lawyer too.

well if i did call her i probley would not take it to court.

i am going to do some reading and find out about taking her to a small claims court. if i do thought i doubt i will get a laywer for it. i mean if i lose with out a laywer all i lost are court fees. with a laywer i could lose the laywers cost. maybe i will call and get a free consulation see what they say. i will make my mind up when i hear from the insurance company

i just did some reading on small claim courts in PA. it costs like 65 dollars and the amount to send the information about the case. i figure its worth a shot. everything is worth trying whens theres so little to lose.

and they say you should call and try to settle it before you take it to court. so i figured i will get some one to listen to me on the phone when i call.(hopefully i will not need to and her insurance will pay)

the thing i think is crap is they dont have to pay. and if they dont wich the probley will not if i win you have to go through a bunch of crap to collect.

now its a matter of waiting and i hate waiting. makes me smoke more and more i went from half a pack to 1.5 packs a day since this started.

Yes, I agree that they should do something about the point where you win your court case and still have to go through a ton of bulls**t to try to collect.

Well here in Minnesota there are millions of "If you get into a traffic accident and it's not your fault call us, NOW. FREE consultations! No fee if we don't win!" lawyer offices. Just thought it was like that in all states.

Look at it this way...you think it is her fault the accident occured because she did not follow the rules and stop before turning right on red. Think back a little bit, if YOU had followed the rules of your "LEARNERS" permit this would have never happened. You should have never even been on the road at 1:30am in the first place. You are very lucky that your bike is the only thing that was hurt in the crash. You have to be extra careful when riding at night, especially around bar closing time at 1:30. I am sorry this happened bro, but take this experience and learn from it. Take your time learning to ride...when you get your bike fixed or a new bike follow the rules. States create laws requiring people to have learners permits for a reason.

theres no reason i should have a permit

there is no reason i should not have my license besides that the state thinks people under 18 learn slower than adults and that is not true. i have to have a permit for 6 months before i get my license

i passed my msf course. the one guy i took the class with i saw up at a bike night. i rode home with him at night and he stalled it a few times and was still getting comfortable just getting around. now he is orlder than 18 i think he is 24 so he got his license and he is allowed on the road at night even thought i ride better than he does. can some one explain? i cant.

i am very anti the fact that age brings more skills doing anything. practicing and time doing it makes one better at something not age. like my grandmom is one of those people. she is like 67 and thinks becuase she is old she is smart. she never rode a motorcycle but she will tell me you have to balance to keep it up when your going straight at speed. she tell me how if you hit a pebble it will fall over.

so if i were 18 the state would think i can ride a motorycle better and safer. thats not true. if i were 18 that situation would be diffrent? no it would not.

Bookmark that quote and look back on it in 10 years, then again in 20 years and you'll have your own answer. No offense to you bruh but nearly everyone around that age thinks they know much much more than they actually do and only much later come to the realization about out just how wrong they were. But conjecture aside, the stats disagree strongly as well: if you think the laws here are strict look at our m/c laws compared to most other industrialized countries and you'll find them to be the most lax in the world .. WAY too much so imo. Most of Europe has a tiered system and you wouldn't even own the bike you do know for at least another 3 years .. etc.. keep in mind that "even if" you're some exception to the rule and can ride great, if the laws where the way you wanted then you'd be on the road with all the ones who "think" they're much better than they really are and we can all do without that.

Older riders injury/death rates have been rising in recent years as well but most of that is attributed to first time riders with little to no experience jumping on their first bikes later on in life .. if we had the tiered system here that would partially solve that problem as well ... but there will always be those that want little to no gov't involvement vs. those who want to help save them from themselves as well as us on the roads with them .. so you have brought up yet another very partisan debate that most have opinions on that won't change my friend

+1...no offense cyber..seriously...but you are looking at it from the wrong viewpoint...it's not a limitation due to skill...or learning...you are wrong about that...that is NOT the reason...the reason is the choices you make while young can harm you significantly.....

i could go on forever how younger guys around 18-20 make STUPID mistakes when riding like running from cops, speeding, etc....YES older people do that too, but it is a damn epidemic among young testosterone driven guys....so it's for your own good....

your statements alone show you are already probably too arrogant on your bike thinking because a guy is having trouble, you're a great driver....just calm down and wait like the rest of had too....

like i said no offense, but take from some guys who have worked through this stage, it's for your own good...

I have to agree with you both, Cybe and KB.

The license should be base on skill like cyber says.

With what KB says I really have to agree. I think that older folks have more to lose and also with age I've learned to fear most stuff that I never would of if I was 17.

Hell I fear death falling off my bike. I dread making turns and having the bike slip from sand or pebbles in the road. If I was 17 I wouldn't even think twice about it or have the fear.

With age brings wisdom they say. I think with age brings ....fear of dying from unnecessary "stunts".

i never said i think i can ride great. you may have got that buts thats not what i said.

i simply said i could ride better than some one who could barley ride at all. i know my skill level.
i know i am a new rider with very little riding time. i dont think i am better then i am.

i also fear gravel i have gone down on it before. i dont go down the highway on 1 wheel. i have been wanting to ride a motorcycle since i was 15. i did nothing but read for 2 year on the internet about it everyday. i know the dangers. i know how dumb it is to go down the highway on 1 wheel or not wear gear. busy intersections scare the s*** out of me. i fear the same things a older person does. i know most younger people dont but it makes me angry when everyone thinks i ride like that.

that is why i do not ride with any one yet. i only know a few kids around my age with a bike and the ones that do just went out bought them and know very little of how thier bike even works. they ride very dumb. one hit a wall doing 100. i did not know him but he went to my school i think he lived not sure. but i would like to live to ride the track.

compared to most riders i am horrible i do not deny this. but why can a adult in the same situation be in the right and me in the wrong?

all i was saying is that there is no reason i should not have my license becuase of my age. i did everything a adult has to do and more. a new riding adult is the same as a new riding teenager. as you said more adults are in accidents now becuase more are riding. they are new riders same as my self but they are aloud to wreck at night. i cant. why?

i said this becuase i think its wrong that i could get screwed out of 1000s of dollars becuase of age. i worked 35 hours a week after school, saved every dollar, never went out for a year so i could buy my bike. its all i thought about. i gues you could say i was a little obseced about it. every one in my family said i could never ride or afford a bike. then i get it and like 3 weeks latter some drunk b**** decides she does not want to wait for one car to pass and ruins it for me. it makes me a little angry i could get screwed becuase of age.

i hope to be around these forums for a while.
just please do not think of me as most teens with bikes.
i ride in my skill level. i wear my gear. i do not think i am better then i am. i dont think i am invincible. i want to live to ride tommarow.

and i dont just say i actuly ride like this as hard as it may be for you to belive. just have to look out for cars even more next time.
