ยง 46.2-1078. Unlawful to operate motor vehicle, bicycle, electric personal assistive mobility device, electric power-assisted bicycle, or moped while using earphones. It shall be unlawful for any person to operate a motor vehicle, bicycle, electric personal assistive mobility device, electric power-assisted bicycle, or moped on the highways in the Commonwealth while using earphones on or in both ears. For the purpose of this section, "earphones" shall mean any device worn on or in both ears that converts electrical energy to sound waves or which impairs or hinders the person's ability to hear, but shall not include (i) any prosthetic device that aids the hard of hearing, (ii) earphones installed in helmets worn by motorcycle operators and riders and used as part of a communications system, or (iii) nonprosthetic, closed-ear, open-back, electronic noise-cancellation devices designed and used to enhance the hearing ability of persons who operate vehicles in high-noise environments, provided any such device is being worn by the operator of a vehicle with a gross vehicle weight rating of 26,000 pounds or more. The provisions of this section shall not apply to the driver of any emergency vehicle as defined in ยง 46.2-920. (Code 1950, ยง 46-219.1; 1950, p. 882; 1958, c. 541, ยง 46.1-202.1; 1989, c. 727; 1993, c. 126; 1997, c. 36; 2001, c. 834; 2002, c. 254.)


but i dont see anything that says you cant wear one... just not both.

Thats so stupid. So people in cars can have 15" subs banging away and we cant have tiny earbuds. Vote for more retarded people in office.

I rock 2 buds in the ears. Never had a problem with safety or traffic. Maybe speeding, but no bodily harm.

Well don't use earbuds, go back in time and use the boombox, put on the back of your bike and power it, you can turn it up as loud as you want!

I just hooked a sidecart to my cbr and rock with 2 subs and some speakers in there. BAM win win

I use 2 noise cancelling earbuds for any ride over 30 min. Just don't crank it up so loud you cann't think. At 80 mph you cann't much but wind anyways. In town i ride with no buds, but i have been thinking about getting some helmet speakers for my short trip helmet. That way it's less of a pain in the ***. Just like a car stereo to me. When you slow down turn it down.


p.s. - I use a Samsung sansa clip 2gb mp3 player. Works great big buttons for it's size (about the size of a zippo lighter) and only 40 bucks. Just because mp3 players are not an ipod doesn't mean there junk. Apple is just as proprietary as microsoft. I have yet to understand everyone's fasination with an ipod. The major turn off for me is itunes.

I think its helmetaudio that sells speakers that are like 3/16" thick, which I think would be ideal for the helmet vs the buds in the ears mainly because they dont block as much surrounding noise.

Get earbuds that have a volume control on the wire. Problem solved. A lot easier to get to than your mp3.
