Buddy's bike went down....
what really sucks is the bike wasn't the kids, or the buddies....the buddies probably in the clear, but guess who will probably end up paying for the damage to the cars....the guy that owns the bike....and I kind of disagree with the point that the kid learned a lesson, what lesson will that be if he isn't held accountable for his actions? If he has the ***** to just hope on some elses bike without permission, he has absolutely to respect for anything. And will probably get off so easy on this, that he will do something stupid again...in the long run the owner might even end up having to pay the kids medical bills....I say prosecute him for grand theft and criminal damage.....then he might learn something...the only person i feel sorry for is the guy that owns the bike...just doesn't pay to be a nice guy and let someone borrow your bike.

While in emotion, I agree with you, legally, the owner is ultimately responsible for any damages and/or injuries incurred on his vehicle. That means in reality, even the kids parents could sue the owner (and his insurance co.) for the medical bills for the kid. Its an unfortunate reality of the way our laws work. Liability has a direct link to ownership, while the owner may not have been directly involved in the incident, he still bares the financial liability. Would really depend on the judge and his interpretation of the laws, but it still sucks for the owner, even if he doesn't end up paying for more than the repairs to his bike. I'll bet that's the last time he lends his bike out to anyone.
I took business law last semester so I'm pretty familar with how this works in CA. It's like this, if a 1 year old finds your gun and shoots someone it's your fault. If a 19 year old finds your gun and shoots someone it's his fault. He is 19 (a legal adult) and he is aware of his actions.
So AZ, I will bet you one Drakes Coffe Cake that if HighRevver fills us in when this all gets squared away the owner won't end up being responsible fot the two cars, the kids injuries, and his own bike. Unless he happens to be a nice guy and takes the blame for it and lets the kid off, which won't happen.

*UPDATE* The owner is paying for the bike and possibly the cars, So my buddy bought him a beautiful 90gsxr1100 All Blue pretty nice compared to the condition the old FJR was in. Got new matching gsxr leathers and helmet for him to cause he felt so bad.
