Another Accident - Update
well, this is interesting. first off, sorry to hear about another accident, but glad to hear you are ok.
now, if the accident was no fault of my own, i would have not even called my insurance company, their ins should take care of everything. when i got rear ended at a stop light i never called my insurance at all. i called thiers within hours of the accident. they didnt want to give me a rental until i told them my $2000 stereo in my car cant be secured and when it gets stolen, they would be replacing it as well. i had a rental car within the hour. not once did i ever talk to my ins.
if you do talk to them, just dont give them any indication that you are fine. if they ask, tell them you are sore and are going to a DR, thats it. they might offer you like $1000 for injuries, but if you sign this, you cant go back asking for more. i think law allows up to $25,000 to be awarded for soft tissue damage (cartalidge - spelling?). i had all the ambulance chasers calling me the day my police report hit telling me to go to their DR and they would tell them I was injured. soft tissue damage cannot be proven or disproven, so its all about the victims word. i never did cause that **** is just wrong, but if i was really hurting I would have pursued it.

Right ^ But my insurance goes after his insurance. That's how it works. And yes, I hear you about the ambulance chasers lol aren't they something? I haven't been contacted by them yet, but I'd like to consult with them before long. Later today I'm going to the ER. My neck still hurts, can't sleep for **** and I have bad *** headaches off and on still. I also hear a lot of cracking noises when I roll my head. Must be damaged cartilage.
I was in a similar situation in 2000. I did not contact my insurance company at all. They paid for all my DR bills, paid off my car plus gave me 3K toward a new set of wheels. Unlike you I was not wearing my seat belt but according to the report I was. The DR at the ER said I was lucky that I was not wearing one because it would have crushed my sternum, collapsing my ribs into lungs and I would have drowned on my own blood. It was a life altering experience for sure. Now I am extra aware at any type of intersection.
I want to ****ing scream. Back and forth with insurance companies all F ing day. My insurance is handling it as if I was in an accident by myself - pay $500 deductible, covered up to $1000 medical and not even going to cover rental fees.
Got a call from their insurance company and they wanted a recorded statement. I said ok, but when it gets hairy, I'm stopping. Three questions later and I stopped. I said, get the info off of the police report. They were trying to turn things around asking questions like "are you familiar with the area where the accident occured" "what was the weather like" "where were you going" Good bye. I'm getting a lawyer.
Called my insurance back and said 1) I'm not paying a dime for rental. 2) I'm not paying any deductible 3) I'm going to the ER and I'm sending the info/bill to the other guy's insurance 4) The accident was caused by the other guy, he admitted fault, and he got a ticket for failure to yield.
****ing ****. Why do I have to act like a ****ing middle man here? My insurance (state farm) should be taking care of all of this then going after his insurance.
I'm going to the ER...I'm sure they'll be a story to tell about that when I get back...

OMG. Glad you're ok. Same exact thing happened to me, except I was going 45 MPH, airbags failed to go off and I had a NASTY seatbelt mark on my chest for a while. (and bumps,bruises, bruised spleen and a broken foot from me slamming on the brake when I hit)-- Also had State Farm- both of us.
Your first mistake was not going to a hospital. Second was not getting an attorney. Call an accident injury attorney immediatley. That's how I was able to buy my house. :-) He'll tell you what you need to do right away from here on out. Call one NOW NOW NOW

Glad to hear that you are ok first off. Well, my .02, don't mean to come off as an *** or anything, and please no offense intended, but if you are having medical problems resulting from the accident, his insurance should cover those costs. Doesn't sound like some big emotional strain or anything, but who knows. Just saying, I hate how injury lawsuits are thrown around like nothing.....get in an accident and someones paying for god knows what. Personally, I was involved in an accident, cleared of fault, and I started getting the phone calls from lawyers and such saying I needed compensation for my injuries and suffering. Just some bumps and bruises, no big deal, just an accident, wasn't intentional or even negligence, just an accident, **** happens. I refused to pursue the issue as I didn't feel I deserved any monies for something so simple. Just wanted my car fixed is all. Folks nowadays get looked at wrong and they'll sue, want compensation or something, easy money.
Ok, got an update. The damage to the car is just over $4500. They aren't paying for the rental since I don't have rental car on my policy. Now, I gave Enterprise rental the other guy's insurance info, so hopefully they get billed, or at least cover most of it. Now, here's where things get sticky. I can have my car fixed through my insurance under state farm, however, I'll be charged the $500 deductible but will most likely get that back. Or I can wait a while on the other guy's insurance and not have to pay anything.
I also took it upon myself to go up to the municipality where it happened and picked up a copy of the police report. It's a 6 page report that's very thorough and states the other guy was at fault. It also states he received a ticket and was stopped in a 'moving' lane (the going straight lane) while waiting to turn. Clearly his fault. The other insurance co. is giving me a run around and the guy hasn't even called in to give a statement.
Last night I spent 4 hours in the ER to be checked out. No big deal. Had about 8 X-Rays taken and no fractures. However, My neck pain has not changed and neither have my off and on headaches. I have cervical strain and I guess some mangled ligaments.
Today I contacted a lawyer. So, now I have a lawyer representing me for when the **** really hits the fan, which I'm sure it will.
Wednesday I go see my regular physician and see what she does. She'll most likely send me in for an MRI.

it's his insurance company's responsibility to take care of your costs, seriously.
Call any accident attorney and they'll tell you the same.
