A cell phone ban went into effect here Jan. 1st, min. $280 fine, and heavily enforced by police in big unmarked 4x4 trucks -- so they can see down into other vehicles and spot people texting with cell phones in their laps.

Before the ban, at least once a week there would be an accident bad enough to cause total gridlock on the freeway I take home from work. Since the ban, that hasn't happened.

Yeah I've gone a bit mental on drivers over the years, booted in the side of car once when the driver merged into my lane & he & his buddies thought it was hilarious when they didn't give way to a lowly bike rider. When the red mist hits & you feel you're in the right anything is possible. We have phone laws here to, but you still see heaps of people using them. I have a mobile (cell) I take it with me in the car & when I go for a ride in case I need assistance of some kind. That's it, no one will ring me because I don't give out the number. They are the most inane piece of technology, I went for lunch today at a cafe & at a table near us, 5 young(ish) people sitting down for coffee, no conversation (cept for the odd "whateva") all them texting on their phones.
Maybe if more of us did a "Dohcdesol" (not just with idiots in cars, but dicks at the movies, supermarket/bottle O, pubs, & any where people go to socialise) think of the lives you may be saving.
I say good one Dohcdesol, hope you get away with it

I wish i did have carbon knuckels after i did that. I had my new icon pursuit gloves and they have plastic knuckle armor which became sorta bent and distored after that. My hand was swollen but only a slight amount. I was just pissed at the time and just put everything i had into his window. lol

Well I don't want to worry you cause I honestly don't think anything will come from it. But I'd expect a knock on the door and not a letter in the mail...

Theft, assault and destruction of private property. Technically, you mugged her

but honestly what can i get in trouble for. damage to personal property?

1 Theft
2 Breaking into a motor vehicle
3 Assault
4 Illegal possession of property
5 Malicious damage to property

You could be in "deep doo doo"

For me, I applaud your actions.
I'd just like to have seen her face................

I had a similar case before me recently which I threw out on the basis that her actions were
1 illegal
2 endangering the public in general
3 driving without due care and attention...................

I suggested that she
1 keep her window shut
2 stay OFF her cellphone
3 watch the bloody road.

I asked the public Prosecutor if he wished to prefer charges against her- he didn't, so she went home, with no cellphone and a good talking to.
The defendant went home and probably laughed for a week. The defendant (it is ALLEGED) flipped the phone under a truck wheel, so there wasn't much left for the woman to talk on......
Not guilty.............(charges dropped)

I believe the punishment should fit the crime......
Sometimes I love my job................

That's kind of what I was going to say. Assault is an intent crime, and if you intended to put her in fear for her safety and took action that made her think you were just about to do it, that's the crime of assault (in plain language). The sad part is that her scaring the heck out of you by carelessly/negligently talking and paying no attention and screeching to a halt and putting you in fear of peril ISN"T assault, because she wasn't trying to scare you on purpose. However, if she did any physical damage to you, then it becomes a complete tort/civil wrong for which you could sue her. That's the same as the "no harm/no foul" rule in sports.

I often fantasize about having a built in rear firing paint ball gun actuated by a button near the throttle that I could use to back off any ********. That would not only scare the heck out of them but also make them have to slow down enough to wash their windows. In a car, you can hit your brakes to startle the driver behind you, but obviously that's a little foolhardy on a bike.
