Default 05 rr. front fork/allignment question spacing issue

I have installed, tighted down my fork/trees. put the axle in, bolted the calipers down. Set the bike down. and torqued the axle. when i do that....(looking at the bike from the front) the fender bracket is touching aganist the rotor. in the service manual it says i've done everything right (or so i thought) even in terms of where the spacers came off. i've installed/taken off this wheel before. I've switched the spacers around and it does it on the opposite side also. is there something i'm missing? thanks

I've alligned the triple trees. and its slightly better but not really....??? i'm missing something
