Transmission Stuck between first and second and weird whining noise

Ever since I got my bike it hasn't quite felt right while shifting but as of late it's gotten very bad. On occasion I'll get completely locked out of 2nd and it will grind regardless of if I try to force it into second or back down into first. Also last time this happened the bike started whining badly while coasting in neutral. Are my shift forks bent, is my trans shot, or could it just be as simple as needing an oil change (which I have yet to do since I bought the bike last month)?

Hi have you done any maintenance on the bike since you've had it

Nothing regarding fluids as of yet, planning on changing my oil and coolant this weekend. Other than that new tires front and rear, a new rim since the genius who had it before crashed it into a wall and bent it, new chain and sprocket and a few other misc. things. I've heard an oil change will help the bike shift much smoother but its not that it shifts rough its that I'm getting totally locked out of gears.

There are a few things you can look at first before you think about gearbox, like has the chain got enough play in it , and have you tried adjusting the gear lever, that is to take it off the splines and re-install a couple of splines + or - to get the lever coming from a slightly different angle

I actually have an aftermarket clutch lever that I was going to install this weekend so I'll see if after it's installed and dialed in if it makes a difference. Other than that the chain is good so hopefully it's just as simple adjusting my lever.
