If you stick your foot or leg into the chain your doing something wrong.

Rossi doesnt use one.

Im not sure but it looks like that hugger goes over the chain? Wouldn't that be a chain guard. But yea you are right, if you have your foot in that area then you shouldn't be riding at all. But not everyone wears the correct gear.. ever get your pants stuck in your chain on a bicycle?

The top of the swingarm is not the side to be concerned with. The stock ones are primarily for fling-off and rain, imo. I think the use of guards is to prevent an appendage from inadvertently making its way in there; say during a crash or when in close proximity to another rider.
