Could be a partial blockage in the petcock - fine rust particles.
Does it do it at higher speeds/lower speeds with more revs ?
You may have a tank venting problem.
When it stutters, open the fuel cap - if you hear a whoosh, the vent is blocked.

When at idle and low speeds it's awesome/ revs fine only when I get to 5th and 6th gear does it studded and die( very unsafe especially in the construction trafic around here)

Have to agree with Shadow, sounds like it's running out of fuel.

how long before it starts dying at highway speeds. see if you can match that time in a lower gear with the revs up

Yes it does tested yesterday and did the same thing now it won't crank at all. I'm thinking my r/r is done?? Would this be a plausible reason for the problems I've had?

i havent had issues with the r/r but i have had fuel delivery issues. what you are describing matches the symptoms of my fuel delivery issue. it would flow but not enough. the petcock diaphram had a leak and was not opening fully at speed. remove the fuel line from the carbs and check for flow first. a lot cheaper check than replacing the r/r in my book. maybe someone with more experience in the r/r replacement can tell you if the symptoms match that as well.

Ok so when i pull the line it has gas in the line and I've never had fuel problems befor (not that I may not have them now) the only reason I'm thinking it's the r/r is because my battery dies almost every time this happens and I end up havin to call someone. By the way you live Austin? I live in Brenham right down 290

Remove the battery, charge it fully, replace in the bike - should have around 12.7V +
Any less, battery is done.
Start the bike, rev it to 3000 RPM, check the voltage across the battery with a voltmeter - should be 13.5V+
If it's not, then your Reg/rec is toast.
Try it and report back................
