HIT!!!!
heres the story. i live in an appartment complex in texas. we have been having alot of motorcycle theft in my city lately and i got permission from the owner of the appartments to park in the striped area between two parking spaces cause its closer to my house and i can hear anything that goes on out there. i have been parking there for almost a year. any how, this morning i was awakened by a noise that sounded like a bike going down. sure enough, i look out the window to see a white pick up truck that had backed out of its parking space next to my bike and the lady turned too early before she was out of the space. needless to say she hit my bike on the left side with her passanger side of her truck. the bike dumped over on the right side and she drove off before i could get my pants on. i went out side and gathered my witnesses and picked up the bike. all i can say is thank god for frame sliders. still i got slight cosmetic damage such as, large scratch on my upper fairing, left side mid faring scratched, starter cover scratched, both mirrors scratched, right bar end scuffed, exhaust can dented and scratched and right side frame slider severly damaged. since i knew who drove the truck, i wrote a letter discribing the damage done to my vehicle and asked if we could settle this in a peacful manner and left my name and number for her to call me when she gets home. that was 7 am this morning. 7 pm i get a call from her, and she denys the whole thing. says she never saw my bike there and goes to say that she is sorry, but she isnt paying cause i was parked in the striped area. i explained to her that i have permission from the owner of the appartments and she says she doesnt care. i calmly ask her for her name and phone number so i could turn this into my lawyer and she hangs up on me. this lady lives in the appartment right across from me! i called the cops and am waiting on their arival. they said they will treat this as a hit and run collison and get her name and adress for me. my question is, the damage is not too bad, and i could live with it. i would just like to have the bike painted cause some of the scratches bother me. do you guys think its worth pursiuing, or should i just let the byotch go and fix it my self? it suckes to live close to a$$ holes!!!!!!
Ok, the way I understood this is that the white trunk parks in the lot hit you and you are parked between two cars. One of the cars is the white truck? So I take it that you dont have her permission to park there. Just a guess. In any case, whether you have permission or not to park there from both the owner of the spaces, legally you can not park there. The median is there separate the properties and neither of the parties is entitled to that space.
However, because she did hit your ride she can be liable to some degree. Your issue is that the police labeled it as a hit and run. Meaning that you did not see who hit your bike. You have to find someone that can testify to that.
Two things to consider. One do you really want to take her *** to court and sue her for 400 bucks when you are will waste your time and court filing fees on that. Then prove that she done it and then prove the estimated damages. Two, do you really want a pissed of women as your neighbor. She can mess with you later on, like steal your mail or other stuff.
I say just pop the bitches tires, but to it discreetly; have alibis. You’re a kind Texan, but you need some BK justice.

i live in ny so i dont know tx laws. but here your supposed to be in control of your car at all times if you hit a parked car well it pretty much means you werent in control in ny, making that person or in this case her liable for the damages. instead of sueing her why not put the damages threw her insurance company ? people take it much worse when you say your sueing them then if then insurance company pays out

I'd sue her for every penny, plus court costs. Every item that has the tiniest mark on it should be replaced.
well the cops finally showed up last night at 2 am!. the officer was real nice and pretty much told me that no matter where i parked, she was at fault. i would like to just take it through her insurance company, but i dont have her name or anything yet. that will be in the police report due out on wednsday. i do have 2 witnesses that saw the whole accident as well. so i think things are pretty much in my favor. ill keep you updated.
Some people have all the nerve. Never excepting responsiblity for thier actions. I say take her for all she is worth. You gave her a chance to handle this diplomatically and she refused... F' Her!!!
Also, if there is damage to her truck from where she hit you (ie, scratches, paint transfer) I would photograph it as evidence... just in case for later on.

Wow, you guys are good. If you have to go through her insurance company they will notify your company. Then you got to pay the deductable. A hit in run is in no ones favor. Define the term "hit and run" no witnesses!!! Its hard to prove unless you work for CSI. Think about it, in order for you to get the money for your bike you have to claim at least a grand. Deductable, cost of filing a case, time of work, having the damage appraised. That will cost you, that why the claim has to be at less 600 more then the expense. Settle this between her and you, no insurance no courts.
